Bids must be submitted before 4pm on Friday 10 May 2024 in a sealed envelope marked "Sealed Bid" and addressed as follows: Sealed Bid c/o Ms Olga McConnon Head of Finance and Housing County Offices The Glen Monaghan County Monaghan Ireland H18 YT50 Bids should state the specific site that bidders are interested in purchasing and state the amount offered. After the closing date 4pm on Friday 10 May 2024 Monaghan County Council will open the sealed bids and choose which offers to accept. Following that the successful and unsuccessful bidders will be notified and the process of selling the sites will proceed subject to contract and due diligence and subject to Section 183 of the Local Government Act. Monaghan County Council reserves the right to withdraw any or all sites from sale before contracts are exchanged. These sites are situated, in a prime location, at the front entrance, of Latlorcan Glen, a very popular residential area. Plots are detached, from other cul-de-sacs and avenues, within the overall residential development complex. Properties are located opposite a new Crèche facility, currently under construction. Subject property comprises, five residential building sites which are in very close proximity to all services including mains water/sewerage and electric. Please contact these offices to discuss the specific conditions of sale. Sale of sites by Monaghan County Council - Terms and Conditions The site(s) are to be sold on a Determinable Fee Simple basis. If conditions (a) and (b) and (c) are not fulfilled within the time periods specified then the Determinable Fee Simple will end and the sites will return to the full ownership of Monaghan County Council at no cost to Monaghan County Council with no increase in price for work in progress and no added value for enhancement and no interest or other cost associated with the site shall be payable by Monaghan County Council. Failure to comply with conditions (a) and (b) and (c) will result in forfeiture of the site, the site and any work in progress thereon will be forfeited and will return to the full ownership of Monaghan County Council except in any case where a loan provider has registered a charge against the property and the loan provider has taken possession or is in the process of taking possession of the property. If the site becomes a derelict site Monaghan County Council reserves the right to acquire the site via Compulsory Purchase. The Purchaser of a site will also be required to comply with the covenants listed below, which also include the conditions of the determinable fee simple. Conditions The Contract for Sale and the Deed will contain the following conditions: The Determinable Fee Simple will terminate and the Purchaser will lose possession of the Site: (a) If the purchaser fails to make an application for Planning Permission for the Dwelling House on the Site within 18 months of the date of these presents (the date of the signing of the Contract/Deed), or (b) If the Purchaser fails to serve a Commencement Notice on the Building Control Authority and / or fails to commence construction of the Dwelling House (with Planning Permission) on the Site within 36 months of the date of final grant of Planning Permission. (c) If the Purchaser fails to fully erect and complete the construction of the Dwelling House on the Site in compliance with the Specification and serve a Completion Notice within 60 months of the date of final grant of planning permission. and time shall be of the essence in this regard. The Site will return to the ownership of Monaghan County Council if the three conditions above are not complied with. If the Purchaser does not comply with the conditions listed within the time periods specified they will lose the Site and any money they have invested in the Site and Monaghan County Council will take possession of the property at no cost to Monaghan County Council. Covenants The Deed will contain the following Purchaser’s Covenants: 1. To apply for Full Planning Permission for the Dwelling House on the Site within 18 months from the date of these presents (the date of the signing of the Contract/Deed). 2. To make all reasonable efforts to get a Grant of Planning Permission for the Dwelling House on the Site within 36 months of these presents (the date of the singing of the Contract/Deed). 3. To serve a Commencement Notice on the Building Control Authority and to commence construction of the Dwelling House (with Planning Permission) on the Site within 36 months of the date of final grant of Planning Permission. 4. To engage an Assigned Certifier to certify that the Dwelling House, as constructed on the Site, is compliant with the Building Regulations. 5. To register with and use the Building Control Management System in compliance with the Building Control (Amendment) Regulations (S.I. 9 of 2014). 6. To fully erect and complete the construction of the Dwelling House on the Site in compliance with the Specification and serve a Completion Notice within 60 months of the date of final grant of planning permission. 7. To occupy the Dwelling House as the principal place of residence of the Purchaser for a period of 5 years following the completion thereof. This covenant shall not apply to a subsequent owner of the property following repossession by a mortgage provider. 8. Not to do or permit or suffer any act or thing to be done to or on the Site which may become a nuisance or annoyance to the Vendor or an owner or occupier of the Retained Lands or any part thereof or of any adjoining property. 9. Not to use or permit or suffer the buildings on the Site to be used for any purpose other than as a single private Dwelling House with ancillary outbuildings. 10. To keep the Site and the said Dwelling House and outbuildings and the utilities thereon and thereunder in good order repair and condition. Specification The Dwelling House to be constructed on the Site shall conform with the following specifications: 1. The Dwelling House is to be in keeping with and of a similar character to the existing houses in the area. 2. The Dwelling House shall be not more than 3-storeys in height including rooms in the roof/attic.
